AGREEMENT TO OUR LEGAL TERMS

We are Barnes Sewer & Septic LLC (“Company,” “we,” “us,” “our”).
We operate the website https://barnesseptic.com/ (the “Site”), as well as any other related products and services that refer or link to these legal terms (collectively, the “Services”).

These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Barnes Sewer & Septic LLC, concerning your access to and use of the Services. BY ACCESSING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are expressly incorporated herein by reference. We may update these Terms at any time. We will revise the “Last updated” date when changes are made. Your continued use of the Services means you accept the revised Terms.

The Services are intended for users who are at least 18 years old.

1. OUR SERVICES

Information on the Services is not intended for distribution or use in any jurisdiction where such distribution or use would be contrary to law or regulation or would subject us to any registration requirement. If you access the Services from other locations, you do so on your own initiative and are responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (e.g., HIPAA, FISMA, GLBA). Do not use the Services in a way that would subject us to such laws.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We own or license all intellectual property rights in the Services, including the website design, text, graphics, photos, videos, software, databases, and the trademarks/service marks and logos therein (collectively, the “Content” and “Marks”). The Content and Marks are provided “AS IS” for your personal, non-commercial use only.

Your use of our Services

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download/print portions of the Content to which you have lawful access, solely for your personal, non-commercial use.

No Content or Marks may otherwise be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, licensed, or exploited for any commercial purpose without our prior written permission. Requests: office@barnesseptic.com.

Any breach of this Section is a material breach and will terminate your right to use the Services.

Your submissions

If you send us questions, comments, suggestions, ideas, feedback, or other information about the Services (“Submissions”), you assign to us all intellectual property rights in those Submissions and agree we may use them for any lawful purpose without acknowledgment or compensation. You warrant your Submissions are original to you, do not violate others’ rights, and are not confidential.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:
(1) you have legal capacity and agree to comply with these Terms;
(2) you are not a minor;
(3) you will not access the Services through automated or non-human means;
(4) you will not use the Services for any unlawful purpose; and
(5) your use complies with all applicable laws and regulations.

4. PURCHASES AND PAYMENT

We may offer online payments for services (e.g., rentals, pumping, service calls). You agree to provide current, complete, and accurate purchase and account information and to promptly update such information.

All prices are in US dollars and are subject to change. Applicable taxes and fees may be added. We reserve the right to refuse or cancel any order or limit quantities at our sole discretion.

Accepted payment methods may include major credit/debit cards and other methods listed at checkout.

We may correct pricing errors even after payment has been requested or received.

5. POLICY

All sales are final and no refunds will be issued.
For service appointments, rentals, deposits, cancellations, access requirements, or damage/cleaning fees, please review any additional terms presented at booking or on your service agreement/work order; those terms are incorporated by reference.

6. PROHIBITED ACTIVITIES

You agree not to, among other things: (a) systematically retrieve data from the Services; (b) circumvent or interfere with security features; (c) use the Services to harass or harm others; (d) upload malware or spam; (e) engage in automated use (scraping/robots); (f) impersonate others; (g) reverse engineer our software (except as allowed by law); (h) use the Services to compete with us or for any revenue-generating endeavor not authorized by us; or (i) violate any applicable law or regulation.

7. USER GENERATED CONTRIBUTIONS

The Services may allow you to submit content (collectively, “Contributions”). Contributions may be processed per our Privacy Policy. You represent and warrant that your Contributions (and their use by us) do not infringe rights, violate laws, or contain unlawful/objectionable material.

8. CONTRIBUTION LICENSE

You grant us the right to access, store, process, and use information you provide in accordance with our Privacy Policy and your settings. By submitting feedback, you agree we may use and share it for any purpose without compensation. You retain ownership of your Contributions; however, you are solely responsible for them.

9. SERVICES MANAGEMENT

We may monitor the Services for violations; take legal action; refuse, limit, or disable access to any portion of the Services; remove excessive or burdensome files; and otherwise manage the Services to protect our rights and ensure proper functioning.

10. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy at https://barnesseptic.com/privacy-policy/. By using the Services, you agree to our Privacy Policy. The Services are hosted in the United States; by using them from another region, you consent to the transfer and processing of your data in the United States.

11. TERM AND TERMINATION

These Terms remain in effect while you use the Services. We may deny access to and use of the Services to any person for any reason, including violation of these Terms or law, and may remove content at any time without notice. We may also take appropriate legal action.

12. MODIFICATIONS AND INTERRUPTIONS

We may change, modify, or remove the contents of the Services at any time without notice. We are not liable for any modification, price change, suspension, or discontinuance. We do not guarantee continuous availability and are not liable for downtime or interruptions.

13. GOVERNING LAW

These Terms and your use of the Services are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

14. DISPUTE RESOLUTION

Any legal action of whatever nature by either you or us (collectively, the “Parties”) shall be commenced or prosecuted in the state or federal courts located in Indiana, and the Parties consent to and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such courts. The United Nations Convention on Contracts for the International Sale of Goods and UCITA do not apply. No claim arising out of or related to the Services may be brought more than one (1) year after it accrues.

15. CORRECTIONS

Information on the Services may contain errors or omissions, including pricing, availability, or other details. We reserve the right to correct such errors and to change or update information at any time without prior notice.

16. DISCLAIMER

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, COMPLETE, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICES OR THE SERVER ARE FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

17. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA) ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED US $3,000.00. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS; SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless (including our officers, agents, partners, and employees) from any losses, damages, liabilities, claims, or demands, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Terms; (3) any breach of your representations and warranties; (4) your violation of any third-party rights; or (5) any harmful act toward another user you connected with via the Services. We may assume exclusive defense and control of any matter subject to indemnification at your expense.

19. USER DATA

We may maintain certain data transmitted to the Services for operational purposes. Although we perform routine backups, you are solely responsible for all data that you transmit or that relates to any activity you undertake using the Services. We are not liable for any loss or corruption of such data.

20. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services, emailing us, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communication be in writing. YOU AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED VIA THE SERVICES.

21. SMS TEXT MESSAGING

Program Description. By opting in to our text messaging program, you consent to receive SMS messages (e.g., service reminders, delivery/pickup updates, appointment notices) to your mobile number.
Opting Out. Reply STOP to any message to opt out. You may receive a confirmation text.
Message & Data Rates. Message and data rates may apply per your mobile plan and carrier.
Support. For assistance, email office@barnesseptic.com or call (765) 584-7295.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

23. MISCELLANEOUS

These Terms and any policies posted on the Services constitute the entire agreement between you and us. Our failure to enforce any right or provision is not a waiver. These Terms operate to the fullest extent permitted by law. We may assign our rights and obligations at any time. We are not liable for any loss or delay due to causes beyond our reasonable control. If any provision is unlawful, void, or unenforceable, the remaining provisions remain in effect. No joint venture, partnership, employment, or agency relationship is created by these Terms. You waive any defenses based on the electronic form of these Terms and the lack of signing by the parties.
